“physical, sexual, or psychological abuse, as well as neglect, abandonments, and financial exploitation of an older person by another person or entity, that occurs in any setting (e.g. home, community, or facility), either in a relationship where there is an expectation of trust and/or when an older person is targeted based on age or disability.”
There are several state and federal laws governing nursing home neglect and elder abuse: The Elder Justice Act was signed into law by President Obama on March 23, 2010, as part of the Patient Protection and Affordable Care Act. It provides federal resources to “prevent, detect, treat, understand, intervene in and, where appropriate, prosecute elder abuse, neglect and exploitation” to be overseen and managed by the Department of Health and Human Services.
The act requires the establishment of the Elder Justice Coordinating Council, the establishment of an advisory board on elder abuse, the establishment of elder abuse, neglect, and exploitation forensic centers, the enhancement of long-term care, funding to state and local adult protective service offices, grants for long-term care ombudsmen programs and for evaluation of programs, programs to provide training, and grants to state agencies to perform surveys of care and nursing facilities.

There have been a handful of studies on the prevalence of elder abuse many of which approximate in the 10% range and include physical abuse, psychological abuse, verbal abuse, financial exploitation, and neglect. A recent New York based study estimates that some 260,000, or one in 13, elders in the state of New York had been victims of at least one form of elder abuse the previous year. The 2010 United States Census recorded 40.3 million people age 65 and older, the greatest number in United States history. Because the Boomer generation is to continue for the next couple of decades, it is estimated that by 2050, the population of citizens aged 65 and over will be nearly 84 million people.
