The Jones Act is a United States federal law that regulates maritime commerce and requires goods shipped between domestic ports to be transported on ships built, owned and operated by United States citizens or permanent residents. The Jones Act, which was introduced by Senator Wesley Jones and is also known as the Merchant Marine Act of 1920, also formalized the rights of seaman that have been recognized for centuries.
These rights allow those sailors injured while working to make claims and obtain damages from their employers due to the negligence of the ship owner(s), ship captain, and/or fellow members of the crew. The legislation is quite similar to the legislation for railroad workers:
Any sailor who shall suffer personal injury in the course of his employment may, at his election, maintain an action for damages at law, with the right to trial by jury, and in such action all statutes of the United States modifying or extending the common-law right or remedy in cases of personal injury to railway employees shall apply….
An action under the Jones Act can be brought either in a United States federal court or state court and entitles the plaintiff to a jury trial. Sailors have three years from the time of incident to file a lawsuit. If you or someone you know is involved in a maritime accident injury lawsuit and you need money now to pay bills, put food on the table or pay rent, fill out our quick application and a Thrivest Link Specialist will get back to you as soon as possible.
